Gay couple says ‘husband and wife’ requirement is discriminatory

Andrew S. Garib, METRO New York | Link | PDF | A gay couple looking to adopt a child was discriminated against, a new complaint alleges.

A Web site that barred the Manhattan couple from advertising that they were looking to adopt broke New York state laws, according to a complaint filed at the state Attorney General’s office yesterday.

Rosario Gennaro, 40, and Alexander Gardner, 38, sought to create a searchable potential-parent profile on ParentProfiles.com, a Web site owned by Adoption Media, LLC of Arizona. But the site requires potential adopting parents to be a “Qualifying husband and wife couple,” excluding the couple of four years.

“We are committed partners who can provide a loving home for a child,” said Gennaro. “There are lots of children not being given the opportunity to be adopted into great homes.”

The couple married in Canada in May and received certification as qualified adoptive parents from the city in 2007. Gennaro and Gardner want the state’s top attorney to force the company to provide same-sex couples access to the adoption profile site, or bar the it from operating in New York.

A similar case involving a California lesbian couple seeking adoption on ParentProfiles.com ended in 2007 with the company ditching the Golden State rather than complying. End.
